Terms of Service

These Terms of Service (“Terms”) govern your use of the Skimapp mobile application and website (the “Service”), operated by Skigroup Technology Ltd, a company registered in England and Wales (“we”, “us”, or “our”).
By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Service Description
Skimapp is a social ski tracking application that allows groups of friends to share their real-time locations on ski slopes, create meeting points (rally points), and stay connected while skiing. The Service is free to use.
2. Eligibility
You must be at least 13 years old to create an account and use the Service. We do not knowingly collect personal information from children under 13 in compliance with the Children’s Online Privacy Protection Act (COPPA). By using the Service, you represent that you meet this age requirement. If you are between 13 and 18 years old (or the age of majority in your jurisdiction), you confirm that you have the consent of a parent or legal guardian.
3. Your Account
- You are responsible for maintaining the security of your account credentials.
- You are responsible for all activity that occurs under your account.
- You must provide accurate information when creating your account.
- You must notify us promptly if you become aware of any unauthorised use of your account.
4. Acceptable Use
When using the Service, you agree not to:
- Harass, threaten, or intimidate other users.
- Use the app in an unsafe manner while skiing — always prioritise your safety and the safety of others on the slopes. Do not operate the app while skiing at speed.
- Impersonate other people or create accounts with misleading information.
- Attempt to access data belonging to other users or groups you have not been invited to.
- Reverse engineer, decompile, or disassemble any part of the Service.
- Use the Service for commercial purposes without our prior written consent.
- Transmit malware, viruses, or other harmful code through the Service.
5. Location Sharing
The core feature of Skimapp is sharing your location with your group members. By enabling location sharing:
- You consent to the collection of your precise GPS location as described in our Privacy Policy.
- You understand that your location will be visible to all members of any group you join.
- You can disable location sharing at any time from the Profile screen in the app.
- Background location tracking activates automatically when you have joined at least one group. Your location is only stored and shared when you are inside a known ski resort area. See our Privacy Policy Section 9 for full details.
6. Rally Points and User Content
- You retain ownership of rally points and any content you create within the Service.
- By sharing rally points with a group, you grant us and the group members a limited, non-exclusive licence to display that content within the Service.
- You are responsible for the content you create and share. Do not create rally points with offensive or misleading names.
7. Intellectual Property
- The Skimapp name, logo, and brand are the property of Skigroup Technology Ltd.
- The Service uses map tiles provided by MapTiler, which are provided under their own licence terms.
- You may not use our trademarks, logos, or branding without our prior written consent.
8. Disclaimers
The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied.
- Skimapp is not a safety or emergency service. Do not rely on it for safety decisions while skiing.
- We do not guarantee the accuracy, completeness, or timeliness of location data. GPS accuracy varies depending on conditions including weather, terrain, satellite coverage, and device hardware.
- We do not guarantee that the Service will be available at all times or in all locations. Mountain environments may have limited connectivity.
- We are not responsible for the condition of ski slopes, lifts, or resort facilities.
9. Limitation of Liability
To the maximum extent permitted by applicable law:
- Skigroup Technology Ltd and its directors, officers, employees, and agents shall not be liable for any injuries, accidents, deaths, or losses arising from or related to your use of the Service, including but not limited to skiing accidents.
- We shall not be liable for any indirect, incidental, special, consequential, or punitive damages.
- Our total aggregate liability for any claims arising from or relating to the Service shall not exceed the amount you have paid us in the twelve months preceding the claim (which is zero for a free service).
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence.
10. Account Termination
- By you: You can delete your account at any time from the Profile screen in the app. Account deletion permanently removes all your data as described in our Privacy Policy.
- By us: We may suspend or terminate your account if you violate these Terms, engage in harmful behaviour, or if we discontinue the Service. We will make reasonable efforts to notify you before any termination.
11. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes via an in-app notification or by email. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms. If you do not agree with the changes, you should stop using the Service and delete your account.
12. Indemnification
You agree to indemnify and hold harmless Skigroup Technology Ltd and its directors, officers, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable legal fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any rights of a third party.
13. Severability
If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision will be enforced to the maximum extent permissible and the remaining provisions will remain in full force and effect.
14. Force Majeure
We shall not be liable for any failure or delay in performing our obligations under these Terms where such failure or delay results from circumstances beyond our reasonable control, including but not limited to natural disasters, extreme weather, power outages, internet disruptions, acts of government, pandemics, or failure of third-party service providers.
15. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Skigroup Technology Ltd regarding your use of the Service, and supersede any prior agreements.
16. Governing Law
These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales. If you are a consumer in the EEA or the UK, nothing in this clause affects your statutory rights to bring proceedings in the courts of your country of residence.
